(2) Request for holding land ownership
in commercial zone and residential zone (IEAT 15.1 SOR)

Rules for consideration
Those in charge of consideration shall examine for accuracy and completeness in the application for permission; the criteria used for consideration are as follows:
1. The applicant shall be the industrial entrepreneur and the commercial entrepreneur who is permitted to use land for business undertaking and who is ordinary partnership, limited partnership, or limited company, who is registered under the Civil and Commercial Code already
2. The industrial entrepreneur and the commercial entrepreneur who has foreign shares of more than 49 % is considered as alien juristic person, thus would be granted with benefits in holding land ownership under Section 44 of the Industrial Estate Authority Act B.E. 2522 and its Revision
3. Using area for business undertaking shall be under rules, methods, and conditions for granting permission. The holding of land ownership in the Industrial Estate shall be under the Industrial Estate Authority of Thailand’s Announcement on Rules, Methods, and Conditions in Granting Permission to Hold Land Ownership in the Industrial Estate (alien juristic person holds land ownership for residential purpose)
4. Since IEAT does not allow the entrepreneur to arrange residence for employees and workers in the zone for business undertaking, therefore, the industrial entrepreneur may be permitted to hold land ownership in residential zone and shall follow rules and conditions as follows:
4.1 Land or condominium arranged as residence for employees and workers of the entrepreneur and family of the employees and workers as well
4.2 Land or condominium located in the Industrial Estate at the place of business of the entrepreneur
4.3 The quantity of land area or the number of condominium rooms to be allowed
Expert, skilled craftsman Land Condominium
Executive, expert, and skilled craftsman Not more than 200 square wah per family, but

- Totaling not more than 3 rai for the Industrial Estate in Bangkok, Samut Prakarn, Nonthaburi, Pathum Thani, Samut Sakhorn, Nakhon Pathom

- Totaling not more than 5 rai for the Industrial Estate in other provinces

1 Condominium room per family but

- Totaling not more than 10 rooms for the Industrial Estate in Bangkok, Samut Prakarn, Nonthaburi, Pathum Thani, Samut Sakhorn, Nakhon Pathom

- Totaling not more than 20 rooms for the Industrial Estate in other provinces

Workers in the factory Not more than 100 families per 1 rai but

- Totaling not more than 5 rai for the Industrial Estate in Bangkok, Samut Prakarn, Nonthaburi, Pathum Thani, Samut Sakhorn, Nakhon Pathom

- Totaling not more than 10 rai for the Industrial Estate in other provinces

1 condominium room per 1 family but

- Totaling not more than 100 rooms for the Industrial Estate in Bangkok, Samut Prakarn, Nonthaburi, Pathum Thani, Samut Sakhorn, Nakhon Pathom

- Totaling not more than 200 rooms for the Industrial Estate in other provinces
