1 The factory entrepreneur shall provide for soil and underground water quality assessment and work on the contaminants in soil and underground water to not be higher than the criteria specified, and shall prepare for report on the result of soil and underground water quality assessment to be kept in case for the Department of Industrial Works can call for examination, before the starting day of business undertaking. [2],[3]
2 The examination of soil and underground water quality shall be done by private analysis laboratory listed with the Department of Industrial Wroks or other analysis laboratories as approved by the Department of Industrial Works, and specify the criteria of the contaminants in soil and underground water to be under criteria and method as specified by the Cabinet by publishing in the Government Gazette. [2],[3]
3 In case where it appears in the report on the examination of soil and underground water quality that the contaminants in soil and underground water in any factory is higher than criteria on the contaminant in soil and underground water, the entrepreneur of such factory shall report on the measures to control the contaminant in soil and underground water and measures in reducing the contaminant in soil and underground water so that it shall not be higher than the criteria, and send such report to the Department of Industrial Works or Provincial Industrial Office where the factory is located within 180 days as from the day when it is found that there is the contaminant in soil and underground water in the factory higher than the criteria. The period of time expected to complete the operation on reducing the contaminant in soil and underground water to be not higher than the criteria shall be specified in such report as well. [2],[3]
4 The law specifies standard of soil quality classified under the characteristics of use of land into 2 types that are quality standard of soil that is used for residential and agricultural purpose, and standard of soil that is used for other purposes besides residential and agricultural purpose, parameters that focus on volatile organic compound, heavy metal, pesticide, and other toxin. The method in assessing soil quality and in storing soil sample shall be that specified by USEPA or other methods as approved by the Department of Pollution Control. [1],[2],[4]
