22 Issues of The Labor Protection Act B.E. 2541
1 The employee whose work is involved with agriculture who has already workred for 180 days is entitled to taking a vacasion leave for not less than 3 woring days, and the employer shall specify such holiday for the employee in advance or as mutually agreed by the employer and the employee. 2 The employee whose work is involved with agriculture can take a sick leave for the number of actual sick days; for the sick leave of more than 3 working days, the employer may instruct the employee to produce first-class doctor’s certificate. [1],[2],[3],[4],[17]

6 The ship owner shall not allow the ship worker of lower than 18 years old to work at night, unless it is the training that is already planned in advance or it is the training on the position of the ship worker that must perform work during such time, and it shall not affect health or well being of the workers, this shall be granted permission from the Director General of the Department of Labor Protection and Welfare first; the night work shal take at least 9 hours, starting from before midnight to after 5 am. 10 Any person shall not provide for work for the worker to work on ship, unless it is permitted by the registrar in applying for permission; and the issuance of permit shall be under criteria, method, and procedures as specified by the Minister of Labor as specified in the Ministerial Regulation. 11 The ship owner shall provide for employment agreement with the ship worker in writing and with signature of the ship owner, by preparing in counterpart, one kept on board and the other one ishall be kept with the shop worker, ready to be inspected by the official. [1],[2],[3],[4],[5]
12 The ship workers is entitled to taking a leave to get out of the ship as agreed by the ship owner unless it is the case due to health reason and well being reason, that shall be under the criteria, method, and procedure as specified by the Director General of the Department of Labor Protection and Welfare . 16 The ship owner shall follow the criteria as specified by law concerned with condition in working on the ship, providing for work for the worker to work as ship worker, the employment condition, sending of worker back, compensation case of damage of ship or sunk ship, standard manpower, facilities, food, and nutrition on board, medical care service, physical protection, health of the worker on board, sea labor certificate and certificate of work on board, and right to assemble by the workers and negotiation. 17 The employer shall specify the starting time and ending time of normal work of the employee in transporation by land for not more than 8 hours a day. [1],[2],[3],[4],[14]
18 The employer shall not allow the employee whose duty is to drive vehicles to work ovetime unless it is agreed in writing by the employee. [1],[2],[3],[4],[14]
19 The employer shall provide for consecutive rest period to the employee who is driver, of not less than 1 hour after driving for 4 hours already. [1],[2],[3],[4],[14]
20 The employer shall not allow the employee whose work is to drive vehicle, to start work on the following working day before 10 hours after ending work on the last working day. [1],[2],[3],[4],[14]
21 The employer and the employee shall mutually agee on the normal work time by specifying the starting time and ending time of work, but must not be more than 12 hours a day, and the total working time in one week shall not be more than 48 hours. [1],[2],[3],[4],[15]

26 Work which is characterized by the fact that the employer cannot allow the employee to stop work on traditional holiday include the followings: (1) work in hotel, entertainment place, food store, beverage store, club, association, medical care center and touring service place, (2) work in the woods, rural area, transportation work and work that cannot be stopped otherwise it may dmage the work. 27 The employee is entitled to taking a leave for training or developing knowledge with the aim for the benefit of the labor and social welfare or to increase skill, expertise and efficiency of work of the employee, or for educational examination as held by the government; the employee shall inform of the cause of leave clearly and shall produce evidence concerned to the employer for not less than 7 days in advance before taking leave in order to be trained; the employer shall not allow the employee to take a leave for training or developing knowledge in case when the employee is once given permission to take a leave for training or developing knowledge alredy of not less than 30 days or 3 times in such year, or in case when the employer deems that the stoppage of work may damage the business. 28 The work that the employer shall not allow the employee lower than 18 years old to work include: (1) work concerned with heat, cool, vibration, and noise that may be dangerous as specified by law, (2) work concerned with chemicals which is dangerous, toxic, explosive, or inflammable substance as specified by law, (3) work that is concerned with the toxic microbe that may be virus, bacteria, fungus, or others as specified by law, (4) work concerned with driving forklift or crane using engine power or electricity, (5) work that is concerned with all kinds of radioactivity. 29 The work in petroleum business under the specification of law on petroleum including the work on maintenance and work to provide service concerned with such work, as specified by law to be protected. [1],[2],[3],[4],[11]
30 Professional work or academic work on management and clerk management, trading, service concerned with production, or work concerned with such work, the employer and the employee may mutually agree to specify the normal working time in one day in the number of hours, the total work time in one week shall not be more than 48 hours. 31 For the work in the food store or beverage store that opens for uncontinuous servce in each day, the employer may arrange the employee to have rest period for more than 2 horus per day. [1],[2],[3],[4],[11]
32 The employer may arrange the female employee to work in the profession or academic concerned with survey, digging, separation of the petroleum product if the condition is not dangerous to such employee. [1],[2],[3],[4],[11]
33 The employer may allow the pregnant employee who work in the position of management, academic, administrative work, fiannace and accounting to work overtime on working day and this shall be agreed by the employee. [1],[2],[3],[4],[11]
34 For the employee works in the hawking store or who solicit customers to buy goods, if the employer pays commission pay from selling godos to the employee already, such employee is not entitled to receiving overtime pay and holiday overtime pay, unless the employer agrees to pay ovetime pay or holiday overtime pay to the employee. 35 The work that is to watch the place or property, is the kind of work that the employee is not entitled to receiving ovetime pay and holiday overtime pay, but is entitled to receiving compensation in form of money equal to the wage rate per hour on working day. [1],[2],[3],[4],[12]
36 The employer who hires the employee to work related to agriculture and work that is to be done at home, does not have to use Labor Protection Act B.E. 2541 (1998), but shall specify the criteria and conditions under Ministerial Regulation on the labor protection in various cases concerned.
