3.2 Extension of Land Utilization and Business Operation in The Industrial Estate

Details
1. The mit in using land and in business undertaking in the Industrial Estate shall be applied untilt ehend of the fifth calendar year as from the day when the permission is granted.
2. Aplication for the renewal of permit shall be submitted by the entrepreneur before the expiry term of the permit; after submitting, it shal be deemed that the applicant is in the position of peson who receives permit until there is final order not permiting the renewal of the permit.
3. In considering the application for renewal of the permit, there are procedures for the facory inspection, where there shall be appointment between IEAT staff and the coordinator (factory)
4. In case the factory is under the specification of law to take action to prepare for EIA/ EHIA report, such factory shall present the actions, preventive measures and corrective measures on the environmental impact and the measures to reduce the environmental impact in the EIA/ EHIA report to the factory inspector.
5. In case during the submission fo the renewal of permit, it appears that the factory and machine is not correct, the competent official shall order for correction within the specified period of time.
Remarks:
1. The consideration period under this manual shall be started when the factory is inspected and the document is examined completely already.
2. The period of time for the consideration as appear above the manual is the consideration for general normal case that does not include the following cases:
2.1 In case when the applicant submits the application during November and December, which is the period when there is consideration for renewal of permit in conducting business in the Industiral Easte, the period of consideration time shall not exceed that as determined in item 11 of the Regulations of the Industrial Estate Authority of Thailand Committee on the criteria, method, and condidion in conducting business in the Industiral Estate B.E.2 551 (2008), that is within 30 days as from the day when receiving the application, except for the necessary case when the consideration must be done from other agencies, then it is possible to extent the period of time of informing the result of consideration until such agency considers already, after that, the Indusrial Estate Authority of Thailand shall inform the applicant within 7 days as from the day when being informed from such government agency.
2.2 In case of various considerations on permission in the area of the Industrial Estate of Maptapood and nearby Industrial Estates including the Industrial Estate of Mabtapood, the Industrial Estate of Hem Ratchatawan-ok (Maptapood), the Industrial Estate of Asia, the Industrial Estate of RIL, the Industrial Estate of Padang, the period of consideration time shall not exceed that as determined in item 11 of the Regulations of the Industrial Estate Authority of Thailand Committee on the criteria, method, and condition in conducting business in the Industiral Estate B.E.2 551 (2008), that is within 30 days as from the day when receiving the application, except for the necessary case when the consideration must be done from other agencies, then it is possible to extent the period of time of informing the result of consideration until such agency considers already, after that, the Indusrial Estate Authority of Thailand shall inform the applicant within 7 days as from the day when being informed from such government agency.
2.3 In case when there are many applications in a particular time, more than that can be handled by the official to consider in time, then the official shall inform the applicant of the reason and necessity and inform of the specified period of time to be complete; this shall not exceed that as determined in item 11 of the Regulations of the Industrial Estate Authority of Thailand Committee on the criteria, method, and condidion in conducting business in the Industiral Estate B.E.2 551 (2008), that is within 30 days as from the day when receiving the application, except for the necessary case when the consideration must be done from other agencies, then it is possible to extent the period of time of informing the result of consideration until such agency considers already, after that, the Indusrial Estate Authority of Thailand shall inform the applicant within 7 days as from the day when being informed from such government agency.
3. The applicant shall apy for service charge in applying for permission within 30 days, othersiwe it shall be deemed that the applicant does not intend to use land for conducting business in the Industrial Estate, the Industrial Estate Authority of Thailand then shall cancel the application of such applicant further.
4. In case when the Industrial Estate Authority of Thailand has letter informing of the correction and the improvement to the factory within the specified period of time, if th efacotry fails to take actions under the specified peiod, it shall be deemed that the applicant does not intend to use land for conducting business in the Industrial Estate, the Industrial Estate Authority of Thailand then shall cancel the application of such applicant further.
